Welcome to MP High Performance (“we,” “us,” “our,” “MPHP”). These Terms & Conditions (“Terms”) govern your access to and use of the website located at mphighperformance.com (the “Site”), and any services, products, bookings, or memberships offered through the Site (collectively, the “Services”). By accessing or using the Site or Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site or Services.

1. Eligibility & Accounts
1.1 Eligibility. You must be at least 18 years old, or the age of majority in your jurisdiction, to use our Services.

1.2 Account creation. You may be required to create an account or provide certain information (e.g. name, email, address, phone number, vehicle details) to book services or join memberships. You agree to provide accurate, current, and complete information and to update it as needed.

1.3 Account security. You are responsible for maintaining the confidentiality of your account credentials, and for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach.

2. Bookings, Services & Pricing
2.1 Service description & availability. We provide mobile car detailing, including interior detailing, engine bay cleaning, seat cleaning, headlight restoration, and other related services in the Orlando, Florida area (and surrounding communities).

2.2 Quotes & pricing. All pricing displayed on the Site or in communications is an estimate and subject to change due to vehicle condition, size, additional requests, or access issues. We reserve the right to adjust pricing accordingly.

2.3 Confirmation & scheduling. Your booking is confirmed only after we send you a confirmation (via email, text, or other method). We will assign a time window for the service.

2.4 Access & site conditions. You must ensure that our mobile team can access your location (driveways, parking, water, power, safe working area). We reserve the right to refuse or reschedule service if conditions are unsafe, inaccessible, or materially different than communicated.

2.5 Cancellation & no-show policy.We have a 24-hour cancellation policy. Any appointment canceled within 24 hours of the scheduled service time will be charged a $50 cancellation fee.

A no-show occurs when we arrive at your location for the service but no one is present. In the event of a no-show, you will be charged the total price of the detail service booked.

For members, a late cancellation or a no-show will be counted as one of your four monthly details.

2.6 Weekend availability. For any weekend availability inquiries, please reach out to us by email at Contact@MPHighPerformance.com or by phone.

2.7 Payment. Payment is due as specified at the time of booking or upon completion of service (or per your membership). Acceptable payment methods will be those we specify (credit card, debit card, etc.). You authorize us to charge your payment method for the amounts due.

2.8 Membership / subscription packages. If you enroll in a recurring membership or package (monthly plans, etc.), you authorize recurring billing and agree to the membership terms. You may cancel per the cancellation policy provided in the membership agreement.

3. Refunds & Disputes

3.1 Inspection & satisfaction. Upon completion of services, you should inspect the work. If you identify issues or deficiencies, notify us promptly so we may address them.

3.2 Refunds. Refunds or credits (if any) are at our discretion and shall be handled in accordance with our refund policy.

3.3 Disputes. Any dispute arising from or relating to these Terms or the Services must first be raised with us in writing. If unresolved, such disputes shall be governed by the “Governing Law & Dispute Resolution” section below.

4. Intellectual Property

4.1 Ownership. All content on the Site (text, graphics, images, logos, software, designs, etc.) is owned or licensed by us and protected by copyright, trademark, and other intellectual property laws.

4.2 Limited license. You are granted a limited, non-exclusive, non-transferable license to access and use the Site for your personal, noncommercial use, subject to these Terms.

4.3 Restrictions. You may not copy, distribute, modify, republish, reverse engineer, or otherwise use the Site or its content except as expressly permitted under these Terms.

5. User Conduct & Prohibited Uses

You agree not to:Use the Site or Services in a way that violates any applicable law, regulation, or third-party right;

Submit false or misleading information;

Interfere with or disrupt the operation or security of the Site;

Use automated means (bots, scrapers) to access or collect data from the Site;

Use the Site for any unauthorized commercial purpose;

Harass, defame, or abuse others.

6. Disclaimers & Limitation of Liability

6.1 No warranty. The Site and Services are provided “as is” and “as available,” without warranties of any kind—express, implied, statutory, or otherwise. We disclaim all warranties to the fullest extent permitted by law (including merchantability, fitness for particular purpose, noninfringement).

6.2 Limitation of liability. To the maximum extent permitted by law, in no event shall MPHP, its owners, agents, employees, or affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages (including loss of profits or data) arising out of or in connection with your use of the Site or Services, even if we have been advised of the possibility of such damages.

6.3 Cap on liability. Our total aggregate liability for all claims under these Terms shall in no event exceed the amount you paid us for the specific service(s) giving rise to the claim.

6.4 Force majeure. We are not liable for failure or delay in performance due to causes beyond our reasonable control (e.g. natural disasters, acts of God, supply chain issues, governmental acts, technical failures).

7. Indemnification

You agree to indemnify, defend, and hold harmless MPHP, its officers, directors, employees, agents, affiliates, and licensors from and against all claims, liabilities, damages, losses, costs, expenses, or demands (including reasonable attorneys’ fees) arising from or related to: (a) your breach of these Terms; (b) your use or misuse of the Site or Services; (c) your violation of any law or third-party rights.

8. Modifications & Termination

8.1 Modifications. We may update or modify these Terms at any time by posting a revised version on the Site, with a “Last updated” date. Your continued use after modification constitutes acceptance.

8.2 Termination. We may suspend or terminate your access to the Site or Services (or any portion) at our discretion, for any reason, with or without notice. Sections that by their nature survive termination (e.g. intellectual property, disclaimers, limitation of liability, indemnification) shall survive.

9. Governing Law & Dispute Resolution

9.1 Governing law. These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law rules.

9.2 Venue. Any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Osceola County, Florida.

9.3 Waiver of jury trial. To the extent permitted by law, you and we each waive any right to a jury trial in connection with disputes hereunder.

9.4 Arbitration (optional). [If you prefer, you can require binding arbitration rather than court litigation; include rules, forum, etc.]

10. Miscellaneous

10.1 Entire agreement. These Terms, along with any additional terms you agree to (e.g. membership agreement, refund policy), and our Privacy Policy, constitute the entire agreement between you and MPHP regarding the Site and Services.

10.2 Severability. If any provision of these Terms is held unenforceable or invalid, the remainder will continue in full force and effect.

10.3 Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer at our discretion.

10.4 Notices. We may send notices via email, postings on the Site, or other means, and such notices will be considered given upon delivery.

10.5 No waiver. Our failure to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision in the future.
